Nazareth man suffers burns in house fire By GAY EWELL Of The Morning Call An elderly Nazareth man was in stable condition in Easton Hospital last night after a fire swept through his home yesterday afternoon. Stephen Domitrovits, 81, of 409 Mauch Chunk was being treated for second-degree burns of the face and hands received in the fire which gutted the first floor of his story frame home. Domitrovits lived alone in the house.

He was apparently in the cellar when the fire broke out, and was injured while escaping. Ginnie Grube, who was visiting her. parents at a house next to Domitrovits', turned in the alarm at 2 p.m. She said, "I looked out the window and saw smoke I quick called the fire company." Ron Hoffner of Upper Nazareth Township was on his way to work at Lone Star Industries, when Domitrovits came out of the house. A former co-worker of the retired Domitrovits, Hoffner said, "I put him in my truck.

He looked a little shocky, like he wanted to go back in there." Vigilance Hose Co. Asst. Chief Ed Statler said last night that the first floor of the home was "fully involved" when fire fighters arrived, and Upper Nazareth Police Chief Fred Klegeisz said the front room was "a ball of flame. Policeman justified in using deadly force, his lawyer says Glenn Laliberte was justified in using deadly force in the Christmas Eve shooting of Thomas BianchiLurati, Bangor Atty. Alan McFall said last night.

He is representing the Pen Argyl patrolman. McFall said that Laliberte was interviewd yesterday at the Bethlehem State police barracks. Trooper Joseph Kocevar and Toop coordinator Lt. Stephen Luchansky were present during the interview. Pen Argyl Police Chief Dwayne Honey accompanied Laliberte but did not participate.

In addition, tapes of police radio transmissions during the incident were reviewed. The tapes were from Blue Mountain Control, the Wind Gap emergency dispatching service. Bianchi-Lurati was shot in the upper chest by Laliberte about 2:30 a.m. in the parking lot of Caesar's Diner outside Wind Gap, following a chase which began in Nazareth. Northampton County Coroner Joseph F.

Reichel had ruled the death a homicide. Laliberte was suspended by borough officials shortly after the shooting, apparently a routine procedure. Northampton County Dist. Atty. Donald Corriere said Sunday that a decision on whether to file charges against Laliberte would be made next week.

Last night Corriere said that he would not release further information on the case until investigations could be concluded, probably next week. "Officer Laliberte was on routine patrol in Pen Argyl on Dec. 25," McFall said, "having come on duty at midnight. "At approximately 2:18 a.m. he (Laliberte) heard a Nazareth officer (Patrolman Bill H.

Johnson Jr.) begin a series of radio trasmissions on the Blue Mountain radio network. "The Nazareth officer in car 5-A (Johnson) indicated he was chasing a vehicle for a traffic offense and that the officer had been involved in a fight with the suspect (BianchiLurati) during the course of the pursuit. Officer Laliberte then heard car 5-A radio to another Nazareth officer in car 5-B, that he was chasing the suspect up Main Street and requested a backup from car McFall indicated he was not sure of the name of the other Nazareth officer invlovled. "About one minute later, Nazareth car 5-A reported that he was still in pursuit and was entering Upper Nazareth Township," McFall continued. "He (Johnson) also said that his police car had just been hit by the suspect's car.

Moments later, John- son requested assistance by other police departments." McFall said Blue Mountain Control tapes indicate that Laliberte radioed that he would respond. "As Laliberte was heading toward Wind Gap, he heard from the other Nazareth units that the suspect's car was headed toward Wind Gap on Jacobsburg Road with the two Nazareth police vehicles in McFall explained. "At 2:22 a.m., Officer Johnson in car 5-A radioed that he had just wrecked his car. 2:23 a.m., car 5-B broadcast a description of the suspect's vehicle as being a Yellow (Ford) Maverick. In the meantime Officer Laliberte had proceeded through Wind Gap on Route 512, then turned left on Jacobsburg Road." McFall said Laliberte, as he approached the area of the Crystal Chalet (on 512 in Bushkill Township), spotted a car heading toward him at a The home, next to the Holy Family social hall, is on the borough border with the township.

The fire was declared under control about 2:20 p.m., but fire fighters were on the scene until about 4:30 p.m. Nazareth fire fighters were aided with manpower from Upper Nazareth Township's East Lawn Volunteer Fire Co. The Hecktown Fire Co. refilled airpacks. Statler said the cause of the fire is still undetermined and an investigation is continuing.

He said the first floor of the home was most severely damaged, with the second floor extensively damaged by smoke and heat. There was no damage estimate last night. 2 juveniles arrested in armed robbery Two juveniles, one from Weissport and the other from Lehighton R.4, were arrested yesterday and juvenile petitions filed against them resulting from the Nov. 7 armed robbery of the Burger King Restaurant along Route 443 in Mahoning Township. State police at Lehighton said the juveniles, 16 and 17 years old, will be referred to juvenile probation authorities.

They were released in the custody of their parents. The arrests were by state police and Police Chief David Ebberts of Mahoning Township. Police said the holdup took place at 1:20 a.m. on the parking lot of the restaurant when receipts amounting to $1,701 were taken from two Burger King employees as they were leaving the establishment. Police said one of the weapons used in the holdup turned out to be a "fake," a replica of a pistol.

The officer yelled 'halt' but the suspect State police said none of the stolen cash was recovered and it is believed it was spent. 2 burglaries reported in Easton Burglars broke into the Temple Covenant of Peace, 15th and Northampton streets, Easton, and stole 25 bottles of liquor and wine, police said yesterday. Police said the thieves smashed a basement window to enter the building.

The alcohol was on display in the social room, police said. They estimated the loss at about $125. In another Easton burglary, intruders broke a window on the east side of Russo's Lounge, 36 S. 11th and forced open two coin-operated machines. Police said they did not know how much change was taken.

McFall used the terms justifiable action, self-defense. "Whether the man had a weapon or not, the confrontation could have put him in the situation of a struggle with the question of who would end up with the gun," he said. "'There was no need for the suspect to use force or cause further alarm, but the suspect still went at him. Under the crimes code it was justifiable to use deadly force." When questioned about the two witnesses who may have seen the incident, McFall said he didn't know anything about them or what they told police. McFall said that Laliberte noticed a male by the telephone booth in the parking lot but did not talk to him.

A question still unanswered is where Bianchi-Lurati was coming from before the original chase began. McFall said he may have been visiting someone in the Nazareth area. House, bar burglaries reported in Bethlehem A $400 gold pin, watches and a radio were reported missing in a burglary discovered early yesterday at the home of Mary Prystash, 1405 E. 8th Bethlehem. In a burglary reported Sunday, police said three or four bottles of liquor were taken from Gert's Bar at 36 W.
